defendant, Western Casualty Company, on defendant's third-party
petition. Harold and Diane Owings purchased a home from a
contractor/builder, Terry Gifford d/b/a Regal Construction
Company, (Gifford). The house was one of several constructed by
Gifford and various subcontractors. Shortly after the Owings
moved into their new home, they discovered several major flaws in
the structure. Unable to obtain satisfaction from Gifford, the
